Liability Waiver & Terms of Use

By checking the acceptance box during registration and using Boop Dog Wash's facilities, you confirm that you have read, understood, and agree to the following terms on behalf of yourself and any dog(s) you bring onto the premises.

1. Eligibility

You must be at least 18 years old to register and use the facility. You represent that you are the owner of the dog(s) you bring, or that you have the owner's authorization and accept full responsibility for the dog(s) in their place. Your access credentials (QR code or other entry method) are personal to you and may not be shared. You are responsible for anyone you allow to enter using your credentials.

2. Unstaffed, Self-Service Facility

Boop Dog Wash is a self-service facility that operates without staff on-site during most hours. You are solely responsible for handling, washing, restraining, and supervising your dog at all times while on the premises. No one is present to assist you, intervene in an incident, or provide emergency aid. In the event of an emergency, call 911.

3. Dog Health & Behavior Requirements

You represent and agree that each dog you bring:

• Is current on rabies vaccination as required by Illinois law and licensed as required by the City of Chicago;
• Is free of fleas, ticks, ringworm, kennel cough, and other contagious or infectious conditions;
• Has no history of biting or attacking people or other animals, and has not been designated dangerous or vicious under any law or ordinance;
• Will remain leashed or otherwise under your direct physical control at all times, except while properly secured in a wash tub;
• Will never be left unattended anywhere on the premises, including in a tub or with restraints attached.

Boop Dog Wash may deny or revoke access for any dog that poses a risk to people, other dogs, or the facility.

4. Assumption of Risk

You understand that handling dogs and using wash bays, tubs, restraints, hoses, sprayers, dryers, ramps, and related equipment involves inherent risks. These include, but are not limited to: slips and falls on wet surfaces; bites, scratches, and other injuries caused by your dog or another dog; allergic or skin reactions to grooming products; injury to your dog from equipment, restraints, water temperature, or dryers; and interactions with other customers and their dogs. You voluntarily assume all such risks, both for yourself and for your dog(s), and for any person who accompanies you.

5. Release of Liability

To the fullest extent permitted by Illinois law, you release, waive, and discharge Boop Dog Wash LLC, its owners, members, employees, agents, landlord, and affiliates (the "Released Parties") from any and all claims, liabilities, damages, or losses — including those arising from the ordinary negligence of the Released Parties — resulting from your use of the facility, the condition of the premises or equipment, or the behavior of any dog on the premises. This release binds you, your heirs, and anyone acting on your behalf.

6. Indemnification

You agree to indemnify and hold harmless the Released Parties from any claims, damages, injuries, or expenses (including reasonable attorneys' fees) caused by you, anyone accompanying you, or any dog under your control — including injury to other people or animals and damage to the premises or equipment.

7. Facility Rules, Clean-Up & Damage

You agree to follow all posted rules and instructions, use equipment only as intended, clean up after your dog throughout the facility (including waste, hair, and standing water in the bay), and dispose of waste properly. You are responsible for damage to the facility or equipment beyond normal wear and tear. Excessive mess, misuse of equipment, or damage may result in cleaning or repair fees charged to your payment method on file, and/or suspension or termination of access without refund.

8. Video Surveillance

The premises are monitored by video cameras at all times for safety, security, and facility management. By entering, you consent to being recorded.

9. Payment, Sessions & Memberships

Wash sessions are billed at posted rates based on time purchased at the terminal. Session time is non-transferable and unused time is not refunded. Membership terms, including billing frequency and cancellation, are governed by the separate membership agreement or posted membership terms in effect at the time of purchase.

10. Privacy & Communications

The information you provide during registration is used to manage your access, process payments, operate our rewards program, and send you service-related communications (such as access updates, safety notices, and account information). We do not sell your personal information. Marketing communications, including promotional texts or emails, are sent only if you separately opt in, and you may opt out at any time.

11. General Terms

Boop Dog Wash may update these terms from time to time; continued use of the facility after notice of updated terms constitutes acceptance. If any provision of this agreement is found unenforceable, the remaining provisions remain in full effect. This agreement is governed by the laws of the State of Illinois.
